Promotion of Access to Information Act, 2 of 2000

1. Introduction

This manual is prepared in accordance with the Promotion of Access to Information Act, 2 of 2000 (“PAIA”), as amended, and the Protection of Personal Information Act, 4 of 2013 (“POPIA”).

PAIA gives effect to the constitutional right of access to information held by private bodies where such information is required for the exercise or protection of any rights.

This manual sets out the procedure to be followed when requesting access to records held by Compliq (Pty) Ltd trading as Compliqq.

  • Compliance with PAIA;

  • Receiving and processing requests for access to records; and

  • Ensuring lawful processing of personal information.

4. Guide on how to use PAIA and how to obtain access to records

The South African Human Rights Commission (SAHRC) has published a guide that explains how to use PAIA to access records held by private bodies.

This guide is available from the SAHRC and provides assistance on:

  • How to make a request;

  • The remedies available if access is denied; and

  • How to submit a complaint.

5. Records available in terms of other legislation

Where applicable, Compliqq keeps records in accordance with relevant South African legislation, including but not limited to:

  • Companies Act, 71 of 2008

  • Basic Conditions of Employment Act, 75 of 1997 (if applicable)

  • Labour Relations Act, 66 of 1995 (if applicable)

  • Tax Administration Act, 28 of 2011

  • Protection of Personal Information Act, 4 of 2013

Access to such records may be subject to the provisions of the applicable legislation.

6. Categories of records held by Compliqq

Compliqq may hold records relating to the following categories:

  • Company incorporation and statutory records

  • Business and operational records

  • Financial and accounting records

  • Contracts and agreements

  • Communications and correspondence

  • Compliance-related records

  • Intellectual property and proprietary information

Not all records in these categories may be available for access, and access may be refused in accordance with PAIA.

7. Records relating to personal information (POPIA)

Compliqq processes limited personal information in accordance with POPIA.

Personal information held may relate to:

  • Clients or prospective clients;

  • Service providers;

  • Business contacts; and

  • Individuals who communicate with Compliqq directly.

Requests for access to personal information are handled in accordance with PAIA and POPIA.

8. Request procedure

A requester seeking access to a record held by Compliqq must submit a written request to the Information Officer.

The request must:

  • Be made in the prescribed form (where applicable);

  • Provide sufficient detail to identify the record requested;

  • Specify the right the requester seeks to exercise or protect; and

  • Explain why the requested record is required for the exercise or protection of that right.

The Information Officer may request proof of identity before processing a request.

9. Fees

A request for access to records may be subject to the payment of a prescribed fee, where applicable, as provided for in PAIA.

Details of any applicable fees will be provided upon receipt of a request.

10. Grounds for refusal of access

Access to records may be refused on grounds set out in PAIA, including but not limited to:

  • Protection of personal information of a third party;

  • Protection of confidential or proprietary information;

  • Commercially sensitive information;

  • Legal privilege; or

  • Information subject to confidentiality agreements.

This PAIA Manual is available on the Compliqq website and may be updated from time to time.
